LABOUR MARKET IMPACT ASSESSMENT (LMIA)
A Labour Market Impact Assessment (LMIA) is a document issued by Employment and Social Development Canada (ESDC) that allows a Canadian employer to hire a foreign worker when no qualified Canadian or permanent resident is available to fill the position.
An LMIA confirms that hiring a foreign worker will not negatively impact the Canadian labour market and, in many cases, is required before a work permit can be issued.
Why Employers Need an LMIA
Most closed (employer-specific) work permits require an approved LMIA. This means the foreign worker can only work for the employer listed on the permit, in a specific role and location.
Employers typically need an LMIA to:
- Fill long-term or specialized positions
- Address labour shortages
- Support permanent residence applications
- Hire workers outside LMIA-exempt programs
Employer Obligations For Lmia-Exempt Work Permits
With limited exceptions, employers offering positions under LMIA-exempt work permit categories must meet certain compliance requirements under Canadian immigration regulations.
These obligations generally include submitting the employment offer through the IRCC Employer Portal and paying the applicable employer compliance fee. Completing these steps is required to support the foreign national’s work permit application and to confirm the employer’s compliance with program requirements.
